Anticorruption events are going on

Azerbaijan Young Lawyers’ Union is continuing anticorruption events. Anticorruption projects are started with the assistance of OSCE, and for the moment is funded by Eurasia Foundation.

In December 10, there will be conducted 2 trainings in Gandja and Khachmaz. At the training information about new legislative acts, law and international and regional conventions will be given. Training will be conducted on the basis of the module prepared within the project.

Beside, in December 19, the round table on Responsibilities of officials for corruption related delinquencies will be conducted in International Press Center with the participation of the governmental bodies, Parliament, NGOs, International organizations and Mass Media will be conducted.

After the training and round tables there will be conducted TV Talk Shows with the participation of youth in order to discuss the problem of corruption.

Regional conference on struggle against corruption had been conducted in Ismayilli region.

On August 15, Regional conference on struggle against corruption had been conducted in Ismayilli region by Azerbaijan Young Lawyers Union (AYLU) - implementing partner of OSCE Baku Office. At the opening speech of the conference which had been conducted in Gulustan Hall, Nadir Adilov chairman of AYLU emphasized that the purpose of the regional anticorruption conferences are to deliver proper information on anticorruption laws to local population and enlightenment. As Nadir Adilov mentioned, the regional conference will be also conducted in other regions, such as Sheki, Lenkoran, Gandja, Sumgayit and Mingechevir.
OSCE Ambassador Mr. Maurizio Pavesi mentioned at opening speech that he appreciate that OSCE support the regional anticorruption conference and these kind of conference are very important for the future from the practical point of view, he said. The Ambassador had been accompanied by economic and environment advisor – Mr. David Swalley.
After the speech of Ambassador, Mr. Inam Karimov – The Chief advisor of Department on work with Law Enforcement of the Presidential Office informed participants a comprehensive information about the Laws and State Program against corruption.
Mr. Mubariz Ahmadov – Executive Procurator of the Analytical- Information Section of Anticorruption Department of the Procurator General Office of Azerbaijan Republic had a speech on “the role Prosecutor General Office on struggling against corruption as a specialized anticorruption unit”. Mr. Mubariz Ahmadov informed participants about the activity principles of the Unit. At the conference the Chief prosecutors of Ismayilli, Agsu and Gabala regions were took part. At the discussions, the representatives of local law enforcement bodies, entrepreneurs, businessmen, advocates and local NGO representatives participated very actively.

The presentation of the book “Compilation of anticorruption documents, laws, decrees, enacments and international conventions” had been held

05.08.2005. Baku. Today The presentation of the book “Compilation of anticorruption documents, laws, decrees, enacments and international conventions” had been held in International Press Centre. (APA). At the opening speech the chairman of Azerbaijan Young Lawyers’ Union (AYLU) Nadir Adilov mentioned that the book is published by AYLU in cooperation with the Commission on Fighting Corruption under the State Council on Public Service Management and financially supported by ABA CEELI.
The advisor of the book Ali Houseynov – chairman of Legal Policy and State Building Commission of the Parliament mentioned that the will be disseminated among law enforcement bodies, NGOs, lawyers. The book will be very useful tool on public awareness raising in our society.
After that the Compiler of the book Inam Karimov – advisor of the section on work with law enforcement of the Presidential Office, Chairman of the Education Commission of the Parliament Shahlar Askerov, parliamentarian Gudrat Hasanguliyev and Fazil Gazanfaroglu and others had a speech.

About the book “Compilation of the anti-corruption documents, laws, degrees, enactments and international conventions”

The book titled “Compilation of the anti-corruption documents, laws, degrees, enactments and international conventions” had been published by Azerbaijan Young Lawyers’ Union (AYLU) with the close assistance of the Commission on Fighting Corruption under the State Council on Public Service Management with the financial support of ABA CEELI.
The Advisor of the book is the Chairman of Standing Commission of the Milli Medjlis (Parliament) on Legal Policy and State Building Ali Houseynov, Editor of the book is the Chairman of AYLU Nadir Adilov and the Compiler of the book is the Leading advisor of the Section on work with law enforcement of the Presidential Office of Azerbaijan Republic Inam Karimov.
The book consists of compilation of the anti-corruption documents, laws, degrees, enactments and international conventions. However, the book also contained a comparative analyzing research of domestic and international legislation on anticorruption written by Leading Advisor of the Military and Administrative Legislation Department of Milli Medjlis Eldar Askerov.
The book is considered for the practitioners of law enforcement bodies, NGOs, law students, scientists and other interested people and consists of 356 pages.
The presentation of the book will conducted by AYLU at the International Press Centre on August 5, 2005 at from 10.00 to 12.00. Representatives of governmental structures, Parliament, law enforcement bodies, NGOs, people working on anticorruption problems and other interested people will take part at the presentation of the book.

Round table on the “Role of tax organs in combating corruption” has been held

15.07.2005. BAKU. Today, Azerbaijan Young Lawyers’ Union (AYLU) held Round Table on the “Role of tax organs in combating corruption” (APA). Nadir Adilov Chairman of AYLU had an introductory speech and emphasized that the project is implemented with financial assistance of Eurasia Foundation. He mentioned that within the project three sich events will be conducted. Inma Karimov Seniour Advisor of the Presidential Office Department on work with law enforcement bodies, secretary of the Commission on Combating Corruption under the Council on the Public Services Regulation gave information about the the measures taken in this field at the institution represented by him. He mentioned that the State Program on Combating Corruption is the main document in this direction. I. Karimov said that the action program of the Commission on Combating Corruption has been drafted. Accordin to this program 8 measures will be taken till the end of the year. With the purpose of preventing corruption, Commission made a decision on recruiting the staff at state bodies on the basis of competition. According to his words, Azerbaijan joint international conventions on combating conventions and undertook obligations.
Najaf Khalilov seniour operations commissioner of the Tax Ministry Internal Security Office tauched upon the role of the institution represented by him in the field of combating corruption and gave information about measures taken. N. Khalilov said that the government takes great measures for prevention of corruption: “With the purpose of preventing negative situations documentation is conducted in the tax system. For this purpose, Ministry joins various international programs. TACIS program provided EUR 1.5 million for improvement of the tax system. With the purpose to decrease direct contacts the documents will be submitted via Internet”. He mentioned that 34 persons have been fired, 9 persons have been disrated, 12 persons have been downgraded and a range of measures have been taken concerning about 400 persons for commiting unlawful actions. Elnur Musayev representative Office on Combating Corruption under the Prosecutor General’s Office mentioned that already 10 criminal cases have been started. Elnur Musayev said that the institution is cooperating in this field with other governmental bodies and NGOs. Azer Mammadov representative of Ministry of Internal Affairs Head Office on Struggle against Organized Crimes Division against Corruption and Financial Frauds said that this institution has been newly established under the Ministry. According to his words, this Division aimed to conduct great measures in this field. At the end representatives of state bodies answered questions of the Round Table participants.

Next roundtable will be held on fighting against corruption

There will be held roundtable titled, “The role of tax agencies in fighting against corruption” by Azerbaijan Young Lawyers Union with financial support from Eurasia Foundation (USAID) on July 15, 2005. The roundtable will take place at International Press Center from 9:30 till 13:00. Operation agent and small tax service adviser of the Operation Department of the Internal Security Office at the Ministry of Tax Najaf Khalilov will deliver speech at the roundtable. The role of tax agencies, the importance of financial measures in fighting against corruption and other issues will be discussed at the roundtable.
Government representatives, Milli Majlis members, representatives of international organizations, entrepreneurs and Mass Media representatives will participate in the event.
Discussions will be held after above-mentioned lecture.
Interested persons can participate in the roundtable.

THE BOOK CONTAINING INFORMATION ABOUT ANTICORRUPTION LEGAL DOCUMENTS WILL BE PUBLISHED

Azerbaijan Young Lawyers’ Union with the support from ABACEELI is going to publish the book within the anticorruption activity. Mainly the compilation of the laws on struggle against corruption which is recently adopted, also other national legislative acts on corruption to international legal norms, conventions and other acts will be placed at the book. The comparative analysis will be conducted by national expert. The analysis will be published in the amount of 1000. The book will contain also the texts of adopted legislative acts on struggle against corruption. This book will be published in the form of collection. It will contain adopted laws in the field of corruption as well as decrees and arrangements of President, resolutions of the Cabinet of Ministers, state programs and international conventions in the field of corruption joined by Azerbaijan, resolutions and recommendations of UN and Council of Europe.


The Round Table on the Role of Youth and Young Lawyers in Combatting Corruption has been conducted


29.04.2005. Baku. Today the Round Table on the Role of Youth and Young Lawyers in Combatting Corruption has been conducted by Azerbaijan Young Lawyers’ Union at International Press Centre (APA). The Chairman of Azerbaijan Young Lawyer’ Union stated at the meeting that the adoption of the necessary laws on anticorruption is very important. However, the disappropriate implementation of of the laws ca create a problems to the image of Azerbaijan in the international arena. The chairman mentioned that, for this purpose everyone should apply their duties in implementation of anticorruption laws in order to acctive the effectiveness of the laws. He also informaed particpants about the State Programme on Anticorruption and said that the current meeting is supported financially by Eurasia Foundation. The member of the anticorruption working group within the Cabinet of Ministers Mehriban Garayeva mentioned that we should consider the fact that the laws are only newly adopted. Its normal that the implementation sometimes could be unappropriate. The deputy chief of department of the Ombudsman Office Aydin Sefikhanli said that the anticorruption laws should be still improved. He also mentioned that at the annual report of Ombudsman there were stated the names of the officials who were corrupted and violate the rights of people, asnd as a result the officials are punished.

Training for young lawyers in combatting corruption has been conducted.


Azerbaijan Young Lawyers Union conducted training for young lawyers, youth organizations and NGO representative concerning legislation on combating corruption, state program and other related documents on 6-7 April 2005. As APA informed by the organization there were 22 young lawyers participated from various organizations.



Almammad Nuriyev, Foundation of Constitutional Researches, Avaz Hasanov, Society for Humanitarian Researches, Murad Yahyayev, Member of Board of Azerbaijan Young Lawyers Union and Nadir Adilov, Chairman of Azerbaijan Young Lawyers Union participated in training as experts.



Kazim Guliyev, a monitor of the training from Eurasia Foundation stressed that youth would  play significant role in legal enlightenment in the sphere of combating corruption.
Training has been conducted by support of USAID and Eurasia Foundation.

Round table entitled “The role of civil society and entrepreneurs in combatting corruption” has been conducted. Round table entitled “The role of civil society and entrepreneurs in combatting corruption” has been conducted in International Press Center organized by Azerbaijan Young Lawyers` Union.

Speaker of the meeting Alihuseyn Shaliyev, Director of the Department of Entrepreneurship, Ministry of Economic Development (MED) stated that business culture of business people of Azerbajan does not meet international requirements. He mentioned that it is natural for business people operating in the country transitted to market economy: “I think enough conditions created for development of Azerbaijan entrepreneurship”. As for the comments concerning Tarrif Council, Director stated that the council investigates the accounts given to it by service bodies. According to him, Tarriff Council clarifies logical compatibility of accounts and presents final decision to Cabinet of Ministers.



Alakbar Mammadov, President of Azerbaijan National Confederation of Entrepreneurs stated that there were artificial obstacles for people who wish to be involved in entrepreneurship activity in Azerbaijan. That`s why entrepreneurs involved in corruption without fail. Gudrat Hasanguliyev, Deputy of the Parliament mentioned the illegal decision of MED and Ministry of Finance (MF) regarding increase in prices.

Gudrat Hasanguliyev said that Tariff Council increaed the prices for gas and water since March 1: “Avaz Alakbarov, Minister of Finance stressed that they were being consulted with MED. Two ministers put a law aside and without definite order of Cabinet of Ministers increaed prices for utilities. For commbating corruption reforms should be done in upper levels otherwise there will not be any result”.


Subhi Karimov, representative of Ministry of Justice told about activities of the ministry in the area of combatting corruption: “5110 legal entities registered in 2004 in Azerbaijan. 4946 of them commercial organizations. In 2002 the number of registered legal entities were 2584 and 2003 – 3389. The number of increase is an index of conditions created for development of entrepreneurship in Azerbaijan. The number of foreign investments increases as well. In 2003, 235 institutions were set up by support of foreign investment. In 2003 the mentioned figure reached to 343”. S. Kazimov also stressed importnance of transparency of NGOs parallel with state bodies. According to him, the number of registered non-commercial organizations are 1700. According to legislation, Ministry of Justice registeres the organizations received grant: “Imagine, only 33 organizations gave information to the ministry regarding received grants. According to official statistics of 2004, 33 organizations received grant in 3 mln 300 USD by submitting 107 projects, i.e., 2 percent of 1700 organizations gave information to the ministry concerning received grant. It is interesting that within last year four international organizations gave grant in ammount of 7 mln 694 thousand USD. Therefore, the activity of NGOs is not transparent”.
